Working Time Regulations

If you work regular overtime this should be included in calculating your wage for your holiday pay. As a consequence if you are on holiday you are likely to receive similar pay as you would if you worked your usual over time.

Do you work regular overtime? How much are you paid during your holiday leave?

What does this mean to you?

If your contracted hours are 35 hours a week and you regularly work 5 hours overtime a week then you will be entitled to be paid 40 hours wage while on holiday leave.

The Employment Appeal Tribunal’s ruling on holiday pay, is it going to be appealed in the Court of Appeal? How do the UK Courts interpret the EU Working Time Directive and the Working Time Regulations implemented in the UK in 1998?

A recent ruling in the Employment Appeal Tribunal has reached a decision in favour of what the UN asked for in 1970 and what Europe asked for in 1998. Namely YOU WILL NOW be paid a normal wage for your periods of rest.

BUT Let’s not get too excited as the case is likely to be appealed for now we should appreciate that the Courts are moving towards this significant change.

WE are still waiting for the judgment to be handed down more information will be presented once that is available.
