There are clear guidelines for Courts and Tribunals to apply when they are assessing injury to feelings awards. These are known as Vento bands. From  the 6 April 2020 these are as follows:

  • £900 – £9,000 for lower band offences; This usually involves one off incidents / one act of discrimination.
  • £9,000 – £27,000 for middle band offences; This covers more serious incidents and where the upper band is not suitable. So it may include more acts of discrimination.
  • £27,000 to £45,000 for upper band offences. The upper band is for the most serious acts of discrimination such as campaigns, multiple acts, vendettas which have significantly impacted the employee causing significant levels of stress, anxiety and depression.
